We advise on the buying and selling of real estate across all asset classes, including commercial and industrial buildings, hotel and accommodation facilities, retail shopping centres and ‘big box’ format retail parks.

Commercial, retail + industrial leasing

We act for landlords on significant industrial and commercial portfolios including on agreements for lease, leases and associated side, incentive and fitout deeds and licences.  We also act for tenants on their head office leasing requirements, and in relation to logistics centres, commercial office and industrial premises.

Social + affordable housing

We advise developers and community housing providers on deal structuring, sales, acquisitions and management under Federal and State specific legislation, including in relation to the application of the State Environmental Planning Policy (Affordable Rental Housing) 2009 (NSW)the Housing Act 2001 (NSW), and arrangements with Land and Housing Corporation (LAHC) and Department of Justice and Community Services (DCJ) in relation to the Community Plus scheme and management transfers. 

Build to rent

We advise developers and investors on the acquisition, sale, development and management of Build to Rent (BTR) schemes, including land tax concessions and relevant State Environment Planning Policies (SEPP).

Project development

We acquire sites on behalf of developers, including structuring deals with option deeds, drafting and negotiating Project Delivery Agreements, Project Development Agreements and Development Agreements.

Collective sales and renewals

We advise on collective sale and renewal processes under the Strata Schemes Development Act 2015 (NSW), including process and meeting requirements, formation of a Strata Renewal Committee, preparation of documents and administering strata renewal proceedings in the Land + Environment Court.

FIRB advice

We advise on requirements for foreign investors in relation to the Foreign Acquisitions and Takeovers Act 1975 (Cth), and on applications to the Foreign Investment Review Board (FIRB) for required regulatory approval.

Duane Keighran

Managing Director

Duane Keighran acts for developers, hotel operators, investors, fund managers, landlords, tenants, Community Housing Providers (CHPs), Indigenous businesses and government departments.

 He has received recognition in legal directories and has been noted as “well respected for his work with clients”. Duane is also recommended in Who’s Who Legal for Hospitality in Australia and is listed in Best Lawyers in Australia for Real Property Law.

Duane is also a passionate Non-Executive Director of NSWALC’s social and affordable housing provider, National Housing Limited, tasked with delivering improved housing outcomes for Aboriginal people across communities in New South Wales. A proud Gomeroi man, he has also provided pro-bono and advisory assistance to Indigenous businesses and individuals.

Duane is admitted to practice in New South Wales and holds both a Bachelor of Arts and Bachelor of Laws from the University of New South Wales.

John Momitsas

Senior Associate 

John Momitsas is a Senior Associate in our Real Estate team, bringing over 10 years of experience in the legal industry. He acts for Australian and international investors, developers, fund managers, government departments and private clients.

John has advised and assisted his clients across a broad range of commercial real estate transactions throughout Australia, including acquisitions and disposals, leasing, developments, as well as the provision of property-related and titling advice.

John has a Bachelor of Arts from the University of New South Wales, in addition to a Juris Doctor from the University of Technology Sydney and is a member of the Law Society of New South Wales.

John was previously a volunteer with the Redfern Legal Centre and Marrickville Legal Centre, providing advice and assistance to international students during the COVID-19 pandemic and to young people in need across New South Wales.

Outside of work, John enjoys being by the water, whether it’s going for a surf, snorkel or a swim.
