Development approvals

We advise on development applications and modifications, and statutory appeals and environmental impacts pursuant to Environmental Planning and Assessment Act 1979 (NSW), the Protection of the Environment Operations Act 1997 (NSW) and Environment Protection and Biodiversity Act 1999 (Cth).

Planning agreements

We draft and negotiate State Voluntary Planning Agreements (SVPAs) and Voluntary Planning Agreements (VPAs).

Compulsory acquisition

We administer claims under the Lands Acquisition Act 1989 (Cth) and Land Acquisition (Just Terms Compensation) Act 1991 (NSW), including initial advice, negotiations and compensation appeals.

Contaminated land

We advise on the Contaminated Land Management Act 1997 (NSW) and its regulations, including allocating risk to the appropriate transaction participant, remediation of land and contaminated site development.

Litigation

We appear in all classes of the Land + Environment Court and represent clients before the Supreme Court and Federal Court of Australia.

Land rights + native title

Since commencing practice as a lawyer in Australia, Jim has been one of Australia’s leading environment and planning specialists. He has been an adviser to owners, developers, industry and government on project approvals and regulatory issues for major projects as well as the environment and planning aspects of M&A, financing and other major commercial transactions. These transactions have involved large urban real estate projects, mining and energy infrastructure, energy and transport privatisations, and major industrial facilities. Jim has also been involved in Land and Environment Court, Supreme Court and arbitration proceedings involving environment and planning matters. Jim has also advised in relation to international environmental matters including climate change, acquisition of contaminated land, M&A environmental due diligence on corporate transactions and a class action in Thailand by 1,200 personal injury and property damage claims against a mining client for pollution and land contamination.
